Ben Foster and Laura Prepon’s divorce has taken a contentious turn, with both making serious allegations against each other in newly filed court documents.
The former couple, who were married for six years before separating in 2023, initially cited “irreconcilable differences” when Ben filed for divorce in November 2024. However, in an amended petition, he has now accused Laura of “inappropriate marital conduct.”
According to documents obtained by In Touch, Ben’s legal team argues that their differences have made it impossible for them to remain married. His lawyer stated, “[Ben] would respectfully show that [Laura] has been guilty of such cruel and inhuman treatment or conduct (i.e.; inappropriate marital conduct) towards [Ben] … which renders further cohabitation unsafe and improper.”
Ben is asking for their prenuptial agreement to be enforced and for a court-determined custody schedule for their two children. He has also agreed to pay child support as ordered by the court.
Laura has responded to the claims, denying any wrongdoing in the marriage. In her legal filing, she asserts that any actions she took were justified by Ben’s own behavior.
“[Laura] asserts the affirmative defense to any allegations brought against her that the ill conduct of [Ben] was a justifiable cause for any conduct complained of against her and [Laura] therefore requests that this court dismiss [Ben’s] cause of action for divorce,” her lawyer stated.
Laura has also accused Ben of “cruel and inhuman treatment or conduct” and claims he engaged in “habitual drunkenness.” She is seeking to be named the primary residential parent of their children.
Ben’s lawyer was quick to hit back at Laura’s claims, calling them completely false.
“Laura Prepon’s filing is the definition of falsehood and a disturbing fiction… [Laura’s] decision to engage in a direct character attack on [Ben] in her response is perfectly illustrative of [Laura’s] compulsion to seize and maintain control over every aspect of family life — regardless of who it hurts — and is also a shining example of why [Ben] chose to file for divorce.”
With both sides making serious accusations, this legal battle is shaping up to be anything but amicable.
